- People v. D.C., Case #18CR4841 (January 29, 2020)
- NOT GUILTY verdict for Felony DUI
- Defendant had three DUI priors. His last trial ended in a hung jury (10-2 for guilty). Defendant rear-ended a stopped vehicle in unincorporated Jefferson County where a traffic signal was out due to a power outage. Officer smelled alcohol and administered roadside test for horizontal gaze nystagmus, claiming client showed 6 of 6 clues. Defendant thereafter refused to participate in remaining voluntary field sobriety tests. When he got to the police station, the breathalyzer machine malfunctioned. Defendant refused to go to Golden for retesting. During the retrial, we were able to prevent a refusal instruction under the circumstances and argued that without the test result, the State was simply unable to prove their case beyond a reasonable doubt.
